Definitions
Advertisement: Any advertising material or image supplied by a Candidate & Advertiser for display on the MotorsportCareers.co.uk web site.
Candidate: The person(s), to whom a job search service is provided and who chooses to provide personal information including a copy of their C.V.
Advertiser: The person(s), company or business to whom the Candidate & Advertiser(s) services are provided, namely, advertising of a job vacancy whether this exists or not.
General
By registering or submitting details to MotorsportCareers.co.uk (both advertiser and candidate) we hereby state that we have read the MotorsportCareers.co.uk's terms and conditions and agree with the rules set out governing the use of the MotorsportCareers.co.uk site.
MotorsportCareers.co.uk may at its discretion report any contravention, by the Candidate & Advertiser, of the Data Protection Acts, 1984 and 1998 or any improper use of the site to the Department of Employment, the Data Protection Registrar, the Online Recruitment Marketing Council (ORMC) and the REC.
Any intellectual property, ideas, concepts, or know-how developed by MotorsportCareers.co.uk or obtained during the execution of the services will be owned exclusively by MotorsportCareers.co.uk.
Candidate & Advertiser Responsibilities
The Advertiser enters into the Contract as the principal, notwithstanding that the Advertiser may be an Advertising Agent or an Agency ultimately acting as Agent for an end Advertiser and as principal, warrants that it is authorised by the end Advertiser to place advertisements.
The Advertiser shall comply with the provisions of the Data Protection Acts, 1984 and 1998 in relation to all MotorsportCareers.co.uk's members' details.
It is the Advertiser's responsibility to take up references and to satisfy itself regarding the accuracy, availability, suitability, integrity and reliability of all members whose CVs are provided by MotorsportCareers.co.uk. All and any subsequent dealings between the Advertiser and any member are the responsibility of the Advertiser.
Due to the sensitive nature of information contained in a members CV, the Advertiser shall not transmit or distribute any CV or other information received from MotorsportCareers.co.uk to any person(s), company or business other than for the purpose of finding employment for those members as set out in these terms and conditions.
Should payment made by cheque or BACS not be received and cleared by MIA Recruitment within 30 days of invoice issue date or agreed terms, MotorsportCareers.co.uk reserve the right to de-activate any overdue account without further warning or to cancel any ‘credits' not paid for with immediate effect.
If the defaulting account is de-activated, this time will count against the Advertiser's contracted period and the Advertiser shall have no claim to a refund for the same duration.
MotorsportCareers.co.uk will endeavour to contact the Advertiser before the account becomes overdue to ensure the Advertiser is fully aware of the appending action.
Charges may be made in accordance with the agreed service agreement to recover the overdue amount.
It is the Candidates' responsibility to ensure all personal information is correct and accurate, including CV contents.
MotorsportCareers.co.uk's Responsibilities
MotorsportCareers.co.uk will host advertisements supplied by the Advertiser on its web site, in the form and format agreed and for the fees set out in the contract.
Advertisements will remain live on the site for the agreed paid for period. Advertisers will be notified by e-mail before a vacancy expires and will be offered the option to renew the advertisement. Renewed advertisements will be charged at the normal rate. MotorsportCareers.co.uk has the right and sole discretion to decline, amend or suspend any advertisement received.
Disclaimer
No liability will be accepted by MotorsportCareers.co.uk in connection with any web site controlled by a third party that may be accessed from this web site. MotorsportCareers.co.uk does not endorse or authorise the contents of any such site.
Any material downloaded or otherwise accessed through the use of this web site is obtained entirely at the user's own risk and that the user will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data even if MotorsportCareers.co.uk has been advised of the possibility of such damage.
Responsibility for the contents of job adverts submitted to MotorsportCareers.co.uk rests solely with the Advertiser. In displaying any such advert MotorsportCareers.co.uk do not accept any responsibility for ensuring that material submitted is compliant with all applicable laws and regulations.
MotorsportCareers.co.uk disclaims all warranties (express and implied), representations or assurances of any kind relating to the accuracy, content or fitness for any purpose of the information that appears on the web site.
MotorsportCareers.co.uk reserve the right to withdraw, interrupt or restrict access to the MotorsportCareers.co.uk website for any reason whatsoever.
In no circumstances will MotorsportCareers.co.uk be liable, in contract, tort, (including negligence or breach of statutory duty) or otherwise howsoever and whatever the cause thereof, (i) for any increased costs or expenses, (ii) for any loss of profit, business, contracts, revenues, or anticipated savings, or (iii) for any special, indirect or consequential damage of any nature whatsoever.
Payment Terms and Conditions
Payment is due within 14 days of the invoice. In the case of late payment interest will accrue day to day at the rate of 3% above the official dealing rate of the Bank of England in accordance with the Late Payment of Commercial (Interest) Act 1998.
All MotorsportCareers.co.uk products are subject to these Terms and Conditions. All rates quoted are exclusive of Value Added Tax which shall be added at the applicable rate. By using any of MotorsportCareers.co.uk's sites you acknowledge and agreed to these Terms and Conditions.
Governing Law and jurisdiction
These terms and conditions are governed by the laws of England and the parties submit to the jurisdiction of its courts.
